We are hiring our first Associate Litigation Counsel to join Toast’s Legal team. Reporting to the Assistant General Counsel, Employment & Litigation, the Associate Litigation Counsel will have primary daily responsibility for managing all aspects of Toast’s litigation docket, including investigating and responding to threatened disputes of all kinds, setting strategy and managing outside counsel in active litigation matters, and responding to subpoenas. The Associate Litigation Counsel will work cross-functionally within the Legal team and across the business to develop deep knowledge of Toast and our products and services and provide practical, strategic advice and guidance to Toast management on a wide variety of legal issues that arise in the course of business at a growing public company.

 

About this roll* (Responsibilities) 

  • Manage all aspects of Toast’s litigation docket on a day to day basis
  • Develop strong relationships with other members of the Toast Legal team and business stakeholders, becoming a trusted advisor to internal clients
  • Provide practical and effective advice to Toast management about all aspects of the company's litigation and disputes,  as well as settlement and litigation avoidance 
  • Effectively and strategically manage outside counsel to achieve Toast’s goals in active litigation 
  • Investigate and respond to threatened claims, serving as a passionate and effective advocate for the Company’s position
  • Handle a high volume of legal work, balancing competing priorities and deadlines and keeping stakeholders informed about important developments 
  • Manage responses to third-party subpoenas and develop processes to improve efficiency of Toast’s subpoena management
  • Issue litigation holds and manage discovery as needed.
  • Develop employment law subject matter expertise over time.

 

Do you have the right ingredients*? (Requirements)

  • J.D. from an ABA-Accredited U.S. law school, and membership in good standing to at least one state bar
  • 4+ years of experience of dedicated litigation experience in a law firm setting
  • Experience with all aspects of the discovery process and third-party subpoena management
  • Strong written and oral communication skills to a variety of audiences, including the ability to clearly and concisely explain legal concepts to a business audience
  • Strong business and legal acumen with the ability to: quickly identify legal and business issues; assess and appropriately contextualize risks; and devise creative and practical solutions to various internal and external audiences in a dynamic and fast-paced global environment
  • Ability to work with independence, manage competing priorities effectively, and meet deadlines
  • Passion for collaborating with and the ability to inspire trust and confidence with  a wide range of stakeholders at all levels in a diverse and inclusive environment

 

Special Sauce* (Nice to Haves)

  • Experience working in an in-house legal department
  • Legal operations expertise
  • Background in fintech, technology, and/or software industries
  • Employment law or intellectual property subject matter knowledge
  • Experience with litigation in international jurisdictions
  • Experience working independently in a hybrid or remote environment
  • Commutable distance to the Seaport Boston office preferred

The base salary range for this role is listed below. The starting salary will be determined based on skills and experience. In addition to base salary, our total rewards components include cash compensation (overtime, bonus/commissions if eligible), equity, and benefits.Pay Range$106,000—$170,000 USD
